Legalità e giustizia. (Apologia di un Osservatorio)

Un modo per inaugurare un Osservatorio sulla criminalità nell’agricoltura e sul sistema agroalimentare è di sottolineare che si tratta di un osservatorio sulla legalità. Il termine ‘legalità’ invita a ripercorrere le linee di una classica riflessione: che accosta la legalità (come valore strumentale) ad un valore non negoziabile: la giustizia.

The contribution deals with the relationship between the concepts of “legality” and “justice”, summarizing the terms of a complex relationship, connected with a third fundamental concept: the concept of “law”. Acknowledging justice as foundational feeling and as a factor of legitimacy of legal practices, it reiterates the virtues of procedural conceptions of justice and offers brief remarks on the law as a method and as a social practice for justice.
In this regard it presents that particular way of being of the law, that is the legality (not only in the sense of underlying the term ‘Rechtsstaat’ or the phrase “rule of law” but also in the sense of constitutional legality). Finally, investigates the relationship between legality and justice, presenting arguments on the subordination in any case of the legality to justice, and therefore on the primacy of justice.
